1. Agreement to these terms

By visiting our restaurant, placing an order, making a booking, requesting a catering quote or using the website at https://viethoang79.site, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use our services or website.

2. Who we are

VIET Hoang 79 Pty Ltd (ABN 92 702 108 594) operates a Vietnamese restaurant and food services business in Perth, Western Australia. References in these terms to "we", "us" and "our" mean VIET Hoang 79 Pty Ltd.

3. Orders, bookings and menu items

• All orders and bookings are subject to availability and confirmation by us.
• Menu items, ingredients and prices may change from time to time without notice. Photographs on our website and menus are indicative only.
• We reserve the right to refuse or cancel an order, including where an item is unavailable, an order appears to be made in error or payment cannot be verified.
• Where you make a group booking or function booking, any deposit requirements and cancellation windows will be set out in your written confirmation.

4. Pricing, payment and GST

• All prices are quoted in Australian dollars (AUD) and include GST where applicable, unless stated otherwise.
• Payment is required at the time of purchase unless alternative arrangements have been agreed in writing, such as invoiced catering accounts.
• Catering quotes are valid for 14 days from the date of issue unless we specify a different period in writing.
• Surcharges may apply on public holidays or for special dietary requests, and will be disclosed to you before you confirm your order or booking.

5. Catering services

Catering engagements are governed by the written quote or proposal we provide to you. In the event of any inconsistency between these terms and a signed catering agreement, the signed agreement prevails. You are responsible for providing accurate details about your event, including guest numbers, venue access, delivery timing and any dietary requirements, so that we can deliver the service as quoted.

6. Cancellations and changes

If you need to cancel or change an order or booking, please contact us as early as possible at ceo@viethoang79.site. Cancellation fees may apply to catering and function bookings where costs have already been incurred, and we will always explain these to you in writing before charging them.

7. Australian Consumer Law — your rights

Nothing in these terms excludes, restricts or modifies any rights that you have under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) or any other applicable legislation.

Our food and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, we are entitled to rectify the failure within a reasonable time.

8. Food safety, allergens and dietary information

We prepare our food in a commercial kitchen that handles nuts, shellfish, seafood, gluten, soy, eggs, dairy and other common allergens. While we take food safety seriously and follow all relevant Western Australian food safety requirements, we cannot guarantee that any dish is completely free of trace allergens. If you have a severe allergy, please tell us before ordering so we can advise you honestly about what we can and cannot safely provide. Nutritional and dietary information on our website is general in nature.

9. Website content and intellectual property

All text, images, logos, branding and design elements on this website are owned by or licensed to VIET Hoang 79 Pty Ltd and are protected by Australian and international copyright and trade mark laws. You may view, download and print pages for your own personal, non-commercial use. You must not reproduce, republish or commercially exploit any part of this website without our prior written permission.

10. Limitation of liability

To the fullest extent permitted by law, we exclude all other warranties, conditions and representations not expressly set out in these terms. However, nothing in this clause limits your rights under the Australian Consumer Law. Subject to those non-excludable rights, our total liability arising out of or in connection with your use of this website or our services is limited, at our option, to the resupply of the relevant services or the cost of having the services supplied again.
